MetaSculpt AI - Terms of Service

Welcome to MetaSculpt AI ("MetaSculpt," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the MetaSculpt platform, website, analytics tools, crawlers, and all related services (collectively, the "Service"). By creating an account, accessing the platform, or using any part of the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Description of the Service

MetaSculpt AI provides analytics and reporting tools for AI-generated citations, AI-search visibility, prompt tracking, competitive analysis, and website auditing. The Service may process queries, crawl publicly available content, analyze citation sources, compare your site against competitor data, and store results in our database and cloud storage (e.g., AWS S3).

The Service is continuously evolving and may be updated, modified, or discontinued at any time.

2. User Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity under your account.

We may suspend or terminate accounts for violations of these Terms or misuse of the Service.

3. Acceptable Use

You agree not to:

• Use the Service to crawl or access content you do not have the right or permission to access.
• Violate website terms of service, robots.txt rules, or applicable law.
• Upload harmful, malicious, or unlawful content.
• Attempt to reverse engineer, disrupt, or overload any part of the platform.
• Use the Service for high-risk or unauthorized surveillance activities.

You are solely responsible for ensuring your use of crawlers and analysis tools complies with applicable laws and third-party terms.

4. Data Collection & Storage

By using the Service, you acknowledge and permit us to collect and store:

• Queries you track or submit
• Crawled data from URLs you provide
• Competitive datasets we gather from publicly available sources
• Generated analyses, reports, and statistics
• Account and usage information
• Necessary metadata for billing and operational purposes

We store data in databases, AWS environments, and other secure infrastructure. We retain data as long as needed to provide and improve the Service, unless otherwise required by law.

5. Payment, Subscriptions & Pricing Changes

Payments are processed through LemonSqueezy. We do not store or have access to your full payment card details.

Subscription plans automatically renew unless canceled before the renewal date. Refunds are handled according to our posted refund policy.

We reserve the right to increase or decrease pricing at any time, including but not limited to adjustments required for cloud infrastructure costs, AWS usage variability, or platform maintenance. Notice will be provided in advance of any pricing changes.

Continued use of the Service after pricing changes constitutes acceptance of the new pricing.

6. Intellectual Property

• MetaSculpt owns all rights to the platform, code, architecture, analytics models, documentation, interfaces, and design.
• You retain ownership of any content, prompts, URLs, or data you provide.
• Generated analyses and reports may be used by you for your business needs.
• We may use anonymized and aggregated data to improve the Service.

7. Accuracy & Disclaimer of Warranties

The Service analyzes third-party data sources, AI-generated content, search engines, and websites we do not control.

We do not guarantee:

• Accuracy, completeness, or reliability of analyses
• Availability or consistency of third-party sources
• That crawled data or AI citations will be correct or up-to-date
• That insights will produce any specific business outcome

The Service is provided "as-is" and "as-available," without warranties of any kind.

8. Limitation of Liability

To the fullest extent permitted by law:

• MetaSculpt shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• MetaSculpt is not responsible for decisions you make based on analyses or reports.
• MetaSculpt's total liability shall not exceed the amount paid by you in the previous 3 months.

If you are dissatisfied with the Service, your sole remedy is to stop using it.

9. Termination

We may suspend or terminate your access if you:

• Violate these Terms
• Fail to pay required subscription fees
• Use the Service in a harmful, abusive, or unauthorized manner

Upon termination, you may lose access to stored data. We are not responsible for data loss following account closure.

10. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or platform notice. Continued use of the Service after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the United States and the State of Arizona, without regard to conflicts of law.
